Public Notice: regarding use of IGNOU Study material

Sub: Regarding use of IGNOU Study material on expiry / termination of Agreement of IGNOU with institution concerned for Acquisition of Reproduction Rights, Translation Rights, Adaptation Rights and Reproduction of Translated Study material etc-reg.

This is to bring into the kind notice of all the institutions concerned (be it SOU/DEIs/CCIs/), whosoever have entered into an Agreement with IGNOU for license of using IGNOU study material by way of Adaptation Rights/ Reproduction Rights/ Acquisition of Reproduction Rights /Translation Rights etc. and the term of whose License have already been expired/terminated; that as per the provisions of Clause (VII) of their respective Agreement with IGNOU the institutions concerned are required either to return the licensed study material to IGNOU or to destroy the same. A line of confirmation in this regard is solicited at the earliest.

Further, as per aforesaid Clause, the institutions concerned are also advised not to use the licensed study materials of IGNOU in any form, for any purpose and/or in any manner whatsoever after the date of expiration/termination of their respective Agreements. The Copyright in respect of all the licensed study materials are reserved with IGNOU.

If, it is found at any point of time that any of the licensed materials is being used/has been used by the institution concerned in any manner whatsoever after the expiry of license period, the IGNOU shall have right to claim the full damages from the institution concerned for infringement of its Copyright. Without prejudice to the above, IGNOU shall also have full right to take appropriate recourse in a Court of Law for such infringement.

The dispute, if any shall be subject to the jurisdiction of Delhi Courts only.
